Turk v. USAA

On December 30, 2016 Judge Vicki L. Hogan certified Turk v. USAA, Pierce County Cause No. 14-2-12880-6, as a class action for all USAA insureds with an automobile insurance policy issued in Washington State involving losses under Underinsured Motorist (“UIM”) coverage, where the class member’s vehicle suffered a loss requiring repair, or the vehicle was totaled, and where the class member was without the use of the vehicle for one day or more.  Plaintiffs claim that USAA is responsible to compensate the class members for the “loss of use” of their vehicles, since compensation for loss of use is an element of damages available under Washington law.  Plaintiffs will be requesting a trial date for this case shortly.
